What are the 10 steps for property recovery?
The process is structured and requires cooperation with your lawyer:
- Assignment to a lawyer: You contact your legal advisor, who undertakes the preparation of the file.
- Selection of process: The lawyer chooses the new, faster route of the Restitution Order.
- Deadlines for rent: In case of debts, a 15-day notice applies, followed by 20 days for execution.
- Deadlines for lease expiry: A 3-month extrajudicial notice and a 2-month execution deadline are provided.
- Filing of the file: The lawyer files the application at the Court of First Instance with a fee of €300.
- Appointment of a certified lawyer: The Secretariat randomly appoints an independent certified lawyer for the audit.
- Audit and signature: The certified lawyer checks the documents within 20 days.
- Issuance of the Writ of Execution: The enforceable title is published by the Court of First Instance.
- Service to the tenant: The bailiff serves the writ to the tenant.
- Ensuring time: The law guarantees the tenant a total of at least 6 months to move out in the event of a contract expiration.
Is there still a possibility for a legal appeal?
Of course. If the tenant needs additional time, they retain the right to file an opposition or an application for interim measures. However, the new regulation puts an end to unjustified delays, creating a more balanced framework for property management. 💰
