Who is affected by the mandatory clearing of plots?

According to the new Law 5281/2026, the obligation applies to owners, possessors, usufructuaries, and tenants of properties located within city plans or settlements without an approved plan. It also includes areas within a radius of 100 meters from their boundaries, as well as off-plan land parcels that contain a building. 🏡

What are the critical dates for owners?

Work for the mandatory clearing of plots must be completed from April 1st to June 15th, 2026. However, the owners’ responsibility does not end there, as they must ensure the maintenance of their spaces throughout the fire season, namely until October 31st.

What do the clearing works involve in practice?

The law specifies certain actions for fire protection, which include:

  • Removal of combustible material, such as dry grass, leaves, and broken branches.
  • Logging and removal of trees that touch buildings.
  • Pruning the base of trees to increase height from the ground.
  • Thinning out dense shrubby vegetation.
  • Removal of trash or flammable materials abandoned in the area. 💡

Are there exceptions to the clearing obligation?
